    Terms and Conditions of Use – Website & Mobile Application

     

    Effective Date: 23 June 2023 (Updated for Mobile Application Deployment)

    These Terms and Conditions govern all supply of goods and services (“Products”) by Thomman’s Groccers (“we,” “our,” or “us”) to you, the purchaser and user (“you” or “your”), including your use of the website www.thommans.co.nz (the “Website”) and our mobile application (the “App”).

    By accessing or using our Website or App, you agree to these Terms. If you do not agree, please do not use our services.

    We may update these Terms from time to time. Changes will be effective when posted on the Website and/or App. Your continued use constitutes acceptance of any changes.

    1. Acceptance of Terms
    • Purchases from our Website or App may only be made by individuals acquiring goods or services for their own use or consumption. Goods must not be purchased for resale (whether in trade or otherwise).
    • If you are purchasing on behalf of a company or other entity, you warrant that you are authorised to agree to these Terms on its behalf.
    1. Availability and Supply
    • All orders are subject to availability.
    • If a Product is unavailable, we will either (a) indicate this on the Website/App, or (b) contact you using the details provided.
    • We reserve the right to cancel all or part of an order due to stock shortages or delivery limitations.
    1. Delivery and Delivery Charges
    • Prices shown on the Website or App exclude delivery charges unless stated otherwise.
    • We deliver only to New Zealand street addresses. Delivery charges are as stated at checkout or confirmed by us before dispatch.
    • Frozen items can be couriered, but it will be send separate and may have additional charges to pack it temperature safe.
    • We will make reasonable efforts to dispatch orders promptly after they are placed.
    1. Pricing
    • All prices are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) unless stated otherwise.
    • Prices may change at any time, but confirmed orders remain at the price agreed when placed.
    • Invoices are available by request to the email address provided at checkout. You are responsible for ensuring your details are accurate.
    1. Payment Options
    • We do not accept direct bank transfers.
    • Payments can be made via Stripe or POLi at the time of order.
    • Stripe payments incur an additional 3% surcharge.
    1. Credit Card Security
    • All payments are processed securely via Stripe and POLi.
    • Payment transactions are subject to the terms and conditions of the respective payment provider:

    1. Shipping and Delivery
    • Within Whangarei:
      • Orders over $50 delivered free (within 10km of i-SITE Whangarei).
      • Orders under $50 incur a $5 delivery fee.
    • Outside Whangarei:
      • $2 per km charge applies, or as otherwise advised at checkout.
    • Courier Orders:
      • Standard courier size/weight: 0.05m³ or 25kg.
      • Orders exceeding this may incur additional courier charges.
      • Courier fees will be communicated via email or phone, provided, it is not charged inappropriately by the system.
      • We are not responsible for damages during courier transport. Customers may arrange insurance directly with the courier company.
    • Orders placed before 4pm are processed the same day. Orders after 4pm are processed on the next working day.
    • Customers in Far North may arrange collection by contacting 022 414 4991.

     

     

    1. Website and App Appearance
    • Product images on the Website and App are for illustration only.
    • Actual product size, appearance, and details may vary.
    1. Returns Policy
    • We do not provide refunds or exchanges if you change your mind. Please confirm product details and quantities carefully before ordering.
    • If goods are faulty, we will comply with our obligations under the Consumer Guarantees Act 1993.
    • Products must be checked upon delivery. Any damages or incorrect items must be reported immediately to the delivery person.
    • Clearance category products may be near expiry, expired, or second quality. No refunds or replacements will be provided for clearance items.
    1. Mobile Application Use
    • The App is intended for personal, non-commercial use.
    • By downloading or using the App, you also agree to comply with the rules of the Apple App Store and Google Play Store.
    • You must not attempt to copy, modify, reverse-engineer, or distribute the App without our consent.
    1. User Accounts
    • Some App features require account registration.
    • You are responsible for maintaining the confidentiality of your login details.
    • We may suspend or terminate accounts if false information is provided or Terms are breached.
    1. Notifications & Permissions
    • The App may send push notifications (order confirmations, updates, promotions). You may disable these in your device settings.
    • The App may request optional permissions, including:
      • Location services (for delivery accuracy and store locator).
      • Camera/Photos (for uploading images, if applicable).
      • Storage/Files (for app functionality).
    • Denying permissions may limit some features.
    1. App Updates & Maintenance
    • We may provide updates to improve performance, security, or features.
    • You agree to install updates promptly.
    • We may suspend the App temporarily for maintenance.
    1. Third-Party Services
    • The App may integrate third-party services (e.g., payment providers, couriers, analytics tools).
    • Use of these services is subject to their own terms and conditions.
    • We are not liable for issues caused by third-party providers.
    1. Liability Limitation
    • To the maximum extent permitted by law, we exclude all liability for loss or damage, except where we have acted in bad faith.
    • Our liability (if any) is limited to the value of the faulty Products or services supplied.
    • Nothing in these Terms affects your rights under the Consumer Guarantees Act 1993.
    1. Applicable Law
    • These Terms are governed by the laws of New Zealand.
    • Any disputes shall be resolved in the Courts of New Zealand.
    1. Privacy & Confidentiality
    • Personal information is collected and used in accordance with our Privacy Policy (available on our Website and App).
    • By using the App, you consent to the collection of limited device data for functionality and service improvement.
    • You may request access, corrections, or deletion of your personal data at any time.
    1. General Conditions
    • Failure to enforce any provision does not constitute a waiver of rights.
    • If any part of these Terms is held invalid, the remainder remains in effect.
